Privacy Policy

Updated and approved by the BOCI BOD August 13, 2024

The Bigfoot Owners Club International (BOCI) is an I.R.S authorized, Mutual Bbenefit, non-profit 501(c)(7) Corporation for Bigfoot RV owners. BOCI believes it is important to protect and respect the privacy of its members, users, and visitors. This Privacy Policy covers our treatment of personally identifiable information collected by BOCI through our Website or any other form of communications.

Please read this Privacy Policy so that you will understand both our commitment to you and to your privacy, and how you can participate in that commitment.

1. Website

  1. In general, you can browse the BOCI Website without telling us who you are or revealing any personal information about yourself. We will ask you when we need information that personally identifies you or allows us to contact you (Personal Information). Generally, this information is requested when you become a member of any class or otherwise contact us for information. We use your Personal Information for the following primary purposes:
  • To facilitate your experience on our BOCI Website.
  • To make our BOCI Website easier for you to use by not having to enter information more than once.
  • To help you quickly find information on the BOCI Website.
  • To alert you to upcoming Club events or issues.
  1. BOCI may collect information from you in several different ways including the following:
  • Registration. In order to use the services offered by our BOCI Website, you may be required to create an account with us. During the registration process, you are required to give certain contact information, including, but not limited to, your name, email address, and mailing address. We use this information to contact you about the services on our BOCI Website in which you have expressed interest and to facilitate future related services.
  • Log Files. As is true of most websites, the BOCI Website gathers certain information automatically and stores it in log files. This information includes Internet Protocol (IP) addresses, browser type, operating system, date/time stamp, and movements around the site. We do not link this automatically-collected data to personally identifiable information.
  • Site Usage. BOCI may monitor your activities, preferences, and transactional data (such as your IP address) relating to your use of the BOCI Website and/or services and log this information. This information may be used to diagnose BOCI Website technical problems or problems with your account and to enhance your experience in using the BOCI Website.
  • Cookies. Cookies are data files that are written onto your computer by a website, and stay there unless they expire or are removed by you. Cookies enable us to recognize your computer when you revisit the BOCI Website and recall your preferences to enhance your experience in using it. We do not use cookies to collect or use any information about your visits to other Websites. Consult your browser Help menu to learn more about how you can configure your browser software to notify you when your computer receives a new cookie. Note that you may also be able to configure your browser to disable the creation of cookies entirely (although your full interactive use of the BOCI Website will be adversely impacted if you do this).
  • Pixels Tags and Analytics. We may use other industry standard technologies like pixel tags and analytics tools to track your use of the BOCI Website. When you access the BOCI Website, or open or click an email, pixel tags and analytics tools generate a non-personally identifiable notice of that action. These tools allow us to measure and improve our understanding of visitor traffic and behavior on the BOCI Website, as well as give us a way to measure our promotions and performance.
  1. We may send you strictly service-related announcements when it is necessary to do so. For instance, if our service is temporarily suspended for maintenance, we might send you an email.

2. Other Communications

We may collect personally identifiable information from you in non-website communications, including but not limited to email, letters, phone, event registration forms, etc. We use this information to send and receive club-related information, process registrations, make reservations at your request, receive and send payments, complete purchase transactions, etc.

3. Photography at BOCI Events

  1. BOCI does not regulate photography for personal use by its membership at its Rallies or other events.
  2. BOCI officers or other designated members may take photographs of event activities for the express purpose of adding to a BOCI photo archive, which may then be used to enhance BOCI website content or to publish a rally directory. Publishing portrait photographs and other personal information in a rally directory requires specific permission of the participant, and the directory is given only to the rally participants. Photos included with various rally reports and other webpage content do not require specific permission of the participants depicted.
  3. BOCI may also accept photographs taken and donated by Club members for use at the Club’s discretion. Such photographs shall contain a photo credit with the photographer’s name. (already mentioned in “Terms of Service Agreement”)
  4. We may post photographs depicting events at BOCI rallies or other Club events, either singly or in groups on the website. These photographs may contain recognizable images of people or their Bigfoot RVs. It is impractical to mask or blur out individuals who do not want their faces recognized. Pictures of rigs or people at the rally are generally not published on the website or in a rally directory until a substantial time after the event so they do not reveal a person’s present location at the time of viewing.
  5. BOCI accepts no responsibility for photos, posted by BOCI members on website Forum pages, that display personally identifying information.

4. Disclosure of Collected Information

  1. We will not knowingly disclose to non-affiliated third parties without your prior approval, your e-mail address, phone number, or other personally identifiable information, that we collect about you. However, BOCI will cooperate with official law enforcement inquiries, such as fraud investigations and subpoenas, and will disclose your information when necessary to comply with state and federal laws and regulations.
  2. BOCI cannot ensure that all your private communications and other personal information will never be disclosed in ways not otherwise described in this Privacy Policy. For example, third parties may unlawfully intercept or access transmissions or private communications, or users may abuse or misuse your personal information that they collect from the BOCI Website.

5. Security

We follow generally accepted industry standards to protect the personal information submitted to us from unauthorized access, disclosure, alteration, or destruction, during transmission and once we receive it. If for any reason you believe that BOCI has not adhered to the principles of this Privacy Policy, please notify us through the “Contact Us” link on the BOCI website.

6. Limitations of Warranties and Remedies

  1. To the full extent allowed by law, BOCI disclaims all warranties, terms or conditions, express or implied, either in fact or by operation of law, statutory or otherwise, including warranties, terms, or conditions of merchantability, fitness for a particular purpose, and warranty of non-infringement. BOCI neither assumes nor authorizes any other person to assume for it any other liability in connection with use of the BOCI Website. In no event will BOCI be liable for any incidental, consequential, punitive, or special damages, including, without limitation, lost profits or revenues, even if BOCI has, or should have had, any knowledge, actual or constructive, of the possibility of such damages.
  2. You agree to defend, indemnify, and hold harmless BOCI and its officers against any and all third party claims, suits, costs, losses liabilities and expenses of any kind (including reasonable attorney’s fees) that BOCI may incur arising out of or resulting from the use of the BOCI Website or any of the services of BOCI, the end user, or any other person.
  3. This agreement will be construed and governed according to the laws of the state of California without application of choice-of-law provisions that would require application of the laws of another jurisdiction. By entering into this agreement, all parties irrevocably submit themselves to the exclusive jurisdiction of the state and federal courts in California with regard to any dispute relating to this Privacy Policy or its enforcement. The parties also hereby waive any challenge to venue they may have to a lawsuit filed in a state or federal court in, California, regarding a dispute between the parties relating to this Privacy Policy or its enforcement.
  4. If any provision of this Privacy Policy is found to be invalid, illegal, or unenforceable, the validity, legality and enforceability of any of the remaining provisions will not in any way be affected or impaired and a valid, legal, and enforceable provision of similar intent and economic impact will be substituted therefore.
  5. The foregoing limitations will not be read so as to limit any liability to an extent that would not be permitted under applicable law and specifically will not limit any liability for gross negligence, intentional tortuous or unlawful conduct, or damages for strict liability that may not be limited by law.
  6. Any notices or other communication required or permitted to be made or given by either Party pursuant to this Privacy Policy shall be in writing, in English, and will be deemed to have been duly given when delivered, either personally, or by recognized overnight express courier, U.S. Postal service, or electronically to the address that BOCI may specify in writing.
